Something as routine as buying food can sometimes cause unexpected problems. Among the cases judged by the Superior Court of Justice, there are situations that generate a feeling of indignation, such as realizing that there was less product in the packaging than advertised, to disgusting cases, such as discovering cockroach larvae, cobwebs, insects or even unimaginable objects in the food purchased — and sometimes eaten. The court's jurisprudence on these cases is based on the Consumer Protection Code (CDC).
According to minister Nancy Andrighi, article 8 of the Iran Telegram Number Data code highlights the existence of “a legal duty imposed on the supplier to prevent the health or safety of the consumer from being placed at risk”, also requiring that the necessary and appropriate information be given regarding the product or service sold. If this duty is not fulfilled, manufacturers, producers, constructors and importers must repair damages caused by defects arising from design, manufacturing, construction, assembly, formulas, handling, presentation or packaging of their products, as well as by insufficient or inadequate information about its use and risks, regardless of the existence of fault, as recommended in article.
Moral damage The majority of the STJ's judgments consider it necessary to ingest food with a foreign body in order to constitute compensable moral damage. According to this understanding, the acquisition of a product considered unfit for consumption, due to the presence of a foreign body, without having ingested its contents, does not reveal suffering capable of giving rise to compensation for moral damages.
